VIBR8 Privacy Policy

The VIBR8 Privacy Policy (the “Policy”) explains all the privacy matters you may face when using our website and other websites run by VIBR8 (the “Website”) and VIBR8’s mobile and web-based applications (the “App”), jointly the “Service”, operated by Social Discovery Technology USA LTD. (“VIBR8” or “we”).

This Policy is an integral part of the VIBR8’s Terms and Conditions Use (the “Terms”) and incorporated by reference into them. Please read this Policy carefully, in case you have any ongoing questions about how to exercise your rights, etc., you may also contact us at contactus@vibr8.app.

By using our service/app, you promise us that (i) you have read, understand and agree to this privacy policy, and (ii) you are over 18 years of age. If you do not agree, or are unable to make this promise, you must not use the app/service. In such case, you must (a) delete your account and contact us and request deletion of your data; (b) cancel any subscriptions using the functionality provided by Apple (if you are using iOS) or Google (if you are using Android), any other app stores that may be available from time to time, or by us.

Notice to Users

Despite our best efforts, we cannot control how other users or third-party services may use your data. When using VIBR8, you should presume that everything you post, share or message on the App may be publicly viewable and accessible, both by VIBR8 users and people outside the App. We want you to be careful about going public with your data, thus, we kindly ask you to follow our privacy recommendations as below:

(a) when you post information about yourself or use the messaging function, the amount of personal information you share is determined at your own risk.
(b) you share information with other users when you voluntarily disclose information on the Service (including your VIBR8 profile). That is why we recommend and encourage you to think carefully about the information you disclose about yourself. Please be careful with your data and make sure that the information you publish is data you feel comfortable being publicly viewable;
(c) we do not recommend that you put email addresses, URLs, instant messaging details, phone numbers, full names or addresses, credit card details, national identity numbers, drivers’ license details, precise location and other important data on your VIBR8 profile or send that data via direct messages to people that you do not trust;
(d) we do not recommend that you share your sensitive data (religious denomination, sexual preferences, health details, political leanings, any kind of addictions, etc.) with other users. If you really desire to share this data safely (so as to set up more relevant connections, etc.), you may use VIBR8 tags features. Regarding VIBR8 tags, please read section 1.3 hereof to find out the benefits of their use;
(e) photos that you share via VIBR8 may reveal much information about you; please inspect all of them for data or objects that you do not want to go public with before you upload or share your photos;
(f) please make sure you log out of your VIBR8 profile after use from either your or a third-party’s device since you never know who may get access to them;
(g) please do not share your access credentials (login, email, password, phone number, etc.) with VIBR8 or other social media profiles with anyone else;
(h) we recommend that you change your VIBR8 and other social media password from time to time;
(i) if you think or even have the slightest suspicion that someone may have had access to your VIBR8 or social media profile or access credentials, first of all, change them immediately; if you lost your access to the profile owing to third-party activity, we recommend that you contact us immediately;

VIBR8’s Approaches toward Children’s Privacy

We restrict persons who are under the age of 18 (or the age of legal majority in their place of residence) from using the Services and we do not knowingly collect personal information from anyone under the age of 18.

In the event that we become aware that we have collected personal information from any person who is under 18 years old (or the age of legal majority), we will dispose of that information in accordance with applicable laws and regulations. If you are a parent, guardian or you believe that a user is underaged, please contact us by email or report a profile via the relevant feature in the App.

If we become aware that a person under the age of 18 has registered with VIBR8 and provided us with incorrect personal information, we will take steps to terminate that person’s registration and delete all relevant registration data from VIBR8.

You hereby acknowledge and agree that we may receive your personal data from any third parties (other users, any official bodies, third-party providers, etc.) when you connect your VIBR8 profile with other services, when we receive inquiries, court orders, subpoenas, claims, etc.

We do not collect or store full credit card number information, though we may receive credit card-related information to help process future payments and summary information about transactions that do not include credit card or bank account numbers.

Business Partners

If you register using social network accounts, we may share your profile with those networks.

Service Providers

We share information with service providers who support our business, such as analytics providers.

Corporate Group

Entities within our corporate group may process your information for important functions.

Legal Obligations and Rights

We may share your information to comply with legal obligations, enforce our Terms of Service, or protect our rights and safety.

Corporate Transactions

In case of a corporate transaction, we may share your information with potential buyers or merger partners.

With Your Consent

We may share your information for other purposes with your consent.

Public Activities

Information you share publicly on the App may be read, collected, or used by others.

Advertising

Since we rely on your consent to show you personalized ads, you are entitled to revoke your consent anytime and request that we stop using personalized ads towards you.

Meanwhile, if you opt-out of targeted/personalized advertising you will still see ads, but non-personalized advertising. Such non-personalized advertising may be based on location data that is not linked to the identity of the user and is not classified as personal data itself.

Duration of Processing; Cross-Border Data Transfer

Data Retention

Your data will be stored within the term of your use of the Services and up to the termination of such use (or upon agreement between you and VIBR8) which means the deletion, blocking or suspension of your account on the mobile application and the restriction of your further use of the mobile application; we shall terminate the processing of your personal information, unless the special retention period for the storage of such data is set by the relevant legislation at the time. We may also maintain records to prevent fraud and ensure security, for example when user is banned for violating our terms or misusing our services.

Note, temporary account deactivation, disabling, or “freezing” the app account does NOT qualify as account deletion.

Exemptions

We delete or anonymize your information for California Residents, upon the termination of your profile (deletion of your account) or after two years of your continuous inactivity. There may be special rules applied in case that:

(a) we must hold your data to comply with applicable laws;
(b) we must hold your data to evidence our compliance with applicable laws;
(c) there is an outstanding issue, claim or dispute requiring us to hold the relevant data until it is resolved; or
(d) your data must be kept for our legitimate business interests, such as fraud prevention and enhancing users’ safety and security (see section 6.7 hereof).

Cross-Border Data Transfer

The sharing of information involves cross-border data transfers to the United States of America and other jurisdictions that may have different laws about data processing. If we transfer personal data collected within the EEA to countries with not adequate level of data protection, we use one of the following legal bases: (i) Standard Contractual Clauses approved by the European Commission (any new version of contractual clauses issued by a data protection body (if any)), or (ii) the European Commission adequacy decisions about certain countries. We take steps to ensure that the recipient is bound by E.U. Standard Contractual Clauses together with additional safeguards to protect your personal data. You can see a copy of these clauses. In certain situations, the courts, law enforcement agencies, regulatory agencies or security authorities in those countries might be entitled to access your personal information.

Tracking Technologies

We use cookies and other tracking technologies to improve your user experience and obtain data about how the website is being used. This data enables us to develop and optimize the Website and make the use of the Services more comfortable for you.

Cookies are small pieces of code that are stored in your device (computer, digital tablet, smartphone) when you browse and use online services. Web beacons are small graphic images or other web programming code that may be included in the Website’s and mobile application’s pages and our messages. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a page or email can act as a web beacon. Clear GIFs are tiny graphics with a unique identifier, similar, in function, to cookies. In contrast to cookies, which are stored on a user’s computer hard drive, clear GIFs are embedded invisibly on web pages and are about the size of the period at the end of this sentence.

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this, you may not be able to use the full functionality of our Website.

Your rights in connection with personal information

Under certain circumstances, by law you have the right to:

Object to processing of your personal information where VIBR8 is are relying on a legitimate interest (or that of a third party) and there is something about your particular situation which makes you want to object to processing on this ground. You also have the right to object where VIBR8 is processing your personal information for direct marketing purposes.
Request access to your personal information (commonly known as a “data subject access request”). This enables you to receive a copy of the personal information VIBR8 holds about you and to check that VIBR8 is processing it lawfully.
Request correction of the personal information that VIBR8 holds about you. This enables you to have any incomplete or inaccurate information VIBR8 holds about you corrected.
Request erasure of your personal information. This enables you to ask VIBR8 to delete or remove personal information where there is no good reason for VIBR8 continuing to process it. You also have the right to ask VIBR8 to delete or remove your personal information where you have exercised your right to object to processing.
Request the restriction of processing of your personal information. This enables you to ask VIBR8 to suspend the processing of personal information about you, for example if you want VIBR8 to establish its accuracy or the reason for processing it.
Request the transfer of your personal information to another party in a machine-readable, commonly used and structured format.

The various rights are not absolute and each is subject to certain exceptions or qualifications. For example, if you wish to withdraw your consent or object to processing, VIBR8 may need to discuss with you whether VIBR8’s use of your data needs to continue for other lawful purposes, such as fulfilment of a legal or contractual requirement.

VIBR8 will respond to your request within one month of receipt of your request. In some cases VIBR8 may not be able to fulfil your request to exercise the right before this date and may need to request more time. Where VIBR8 cannot provide a full response to you for any reason, VIBR8 will let you know about this in VIBR8’s initial reply to your request.

Third-Party Websites

The Services may contain links to websites operated and maintained by third parties, over which we have no control. Privacy policies of such linked websites may be different from this Policy. You access such linked websites at your own risk. Similarly, the Service may be accessed and used by third-party websites that we do not control. We have no control over the privacy policies of such third-party websites, and you access such third-party websites at your own risk.

We incorporate commercially reasonable safeguards to help protect and secure your data. At VIBR8, we prioritize the privacy and security of your personal information through robust measures and continuous improvements. Our security setup is built to keep your data safe and includes these key components:

Data Retention Policy: We retain your personal information only as long as necessary to fulfill the purposes for which it was collected or as required by applicable laws and regulations. This ensures that your data is managed responsibly and deleted securely when no longer needed. For more information on data retention and deletion, please refer to Section 6. hereof.
Password Policy: We enforce a strong password policy that includes requirements for minimum length, complexity, and regular changes. Passwords must contain a combination of alphabetic and non-alphabetic characters and cannot be reused for a specified number of cycles. Data transfer control: Measures that ensure that during electronic transmission, transport or storage on data carriers data cannot be read, copied, modified or deleted without authorization, and that it can be established and verified to which entities a transfer of data by means of data transmission facilities is planned. All employees have undertaken to comply with the principle of data secrecy and there are capacities for encrypted data transmissions. Furthermore, the data is deleted in accordance with data protection laws after the end of the commission.
Data protection by design and default: VIBR8 only collects data that is mandatory for the provision of the Services.

To protect you and others, we may monitor your use of the Services and use your personal data and/or other information we collect in order to:

identify and prevent fraudulent activities and transactions,
prevent abuse of and investigate and/or prosecute potential threats to or misuse of the Service,
ensure compliance with the Terms and Conditions and this Policy,

This security monitoring may result in the collection, recording, and analysis of online activity or communications through the Services. If you do not consent to these conditions, you must discontinue your use of the Services.

TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO ANY BREACHES OF SECURITY, DAMAGE TO YOUR DEVICE, OR ANY LOSS OR UNAUTHORISED USE OF YOUR REGISTRATION INFORMATION OR OTHER DATA.

Changes and Updates to Policy

We may revise the Policy according to new developments or advances in legislation and the broader data protection landscape from time to time, so please check this page regularly to ensure you’re always up-to-date with any changes.

If we make any changes hereto that, in our sole discretion, are substantial, we will notify you by email (to the address associated with your profile) or via the App, post a notice within VIBR8 Services or make a notification appear in your profile when you next log in to VIBR8 before amendments become effective.
